LEGAL BASES FOR PARTICIPATION IN THE “TEKKEN8” SWEEPSTAKES
COMPANY ORGANIZING THE PROMOTION
The Company LOFFMUSIC ENTERTAINMENT, SL with address at Paseo del Perú, 48 – 28707 San Sebastián de los Reyes (Madrid) and NIF B44891836 organizes for promotional purposes the sweepstakes (hereinafter, “the Promotion“) of national scope, to be developed through Instagram, exclusively for users residing in Spain and of legal age in accordance with the provisions of the participation requirements section. The purpose of the Promotion is to encourage interaction with the brand and give visibility to it.
- START DATE AND END DATE
The Promotion will start on January 29, 2024, and will end on February 02, 2024 at 24:00h.
The Company reserves the right not to proceed with the promotional action if by the reflected starting date of the promotional action there has not been registered a participation of more than 20 people. Likewise, the Company may extend the termination of the promotional action for 2 more weeks, being the new termination date February 16, 2024 in the event that a greater number of 150 participants are registered.
- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION
It is important to emphasize that participation in the Contest implies unconditional acceptance of and compliance with the provisions of these Terms and Conditions.
The requirements for participation are as follows:
- Participation is open to all persons residing in Spain and over 18 years of age.
- Only participants who have an Instagram account are eligible to participate.
- The personal data shared by the participants must be truthful data.
- Participants may only participate once in this promotion.
The mechanics of the Promotion consist of:
- Follow, obligatorily, the @loff_music account on instagram.
- Indicate which is your favorite character from the video game Tekken8.
- Tag two friends with whom the participant would go to a music festival this summer.
- Include in your comment the hashtag: #loffmusic #tekken8
- PROMOTION CONDITIONS AND PRIZES
Five winners will be chosen by random selection using the AppSorteos application’s draw and certificate system. AppSorteos is a platform that guarantees the transparency of the result of the sweepstakes and as proof of this it issues a certificate of validity for each of its sweepstakes, whose result is unalterable by the organizer of the Promotion, and that any participating user can request to the organizer.
The winners will get as a prize: 1 Tekken8 T-shirt + 1 landyard + 1 keychain.
Winners will be notified on February 06, 2024 by a comment on the Promotion post or through a Storie on the @loff_music account indicating that they have to send a private message to @loff_music with their personal information. The winner may contact the Company during a maximum period of 5 days from the date on which it is announced on the Company’s social profile. If no such contact is made within the stipulated period, the draw will be declared void.
The holding of the draw and the awarding of the prize are subject to the tax regulations in force.
- LIMITATIONS
If it becomes evident that any of the participants do not comply with the requirements set forth in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.
The following persons are not eligible to participate in the Promotion: (i) Employees employed in any of the companies and other entities with legal personality linked to LOFFMUSIC ENTERTAINMENT, SL. (ii) Individuals who directly or indirectly participate in the capital of LOFFMUSIC ENTERTAINMENT , SL. (iii) Any other natural person who has directly or indirectly participated in the organization of this Contest or has been directly or indirectly involved in its preparation or development (agency, suppliers, etc.).
The prize awarded will not be transferable or subject to changes, alterations or compensation at the request of the participants, and cannot be exchanged for any other product or money.
LOFFMUSIC ENTERTAINMENT, SL reserves the right to make any change, suspend or extend this Promotion if there is just cause and prior legal notice.
The winner will be responsible for any fiscal or tax burden that the acceptance of the prize may entail, as well as any other expenses arising from the promotion that are not expressly assumed by LOFFMUSIC ENTERTAINMENT, SL in these Legal Bases.
A period of FIFTEEN (15) calendar days from the date of the awarding of the prize is established to make any reasoned claim. LOFFMUSIC ENTERTAINMENT, SL reserves, in case of necessity, the right to substitute the prize for another of similar characteristics.
- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, abusive or discriminatory or that could violate the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honor, to personal and family privacy and to one’s own image will not be allowed. We will not be responsible for any damage caused by comments made by participants in the Promotion, which at any time may offend the sensibilities of other participants.
Any attempt to hinder the smooth running of the Promotion, either by human intervention or by means of an automaton, will result in the immediate disqualification of the participant and the annulment of his/her candidacy.
The participation in the Promotion, as well as the publication of the comments made by the participants in the publications may not violate under any circumstances the Instagram Community Rules or the Instagram Terms of Use.
- DISCLAIMER OF LIABILITY
By way of example, but not limited to, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the participant with respect to the prize obtained from this Promotion, and assumes no responsibility for any damage or harm of any kind that may be suffered by participants, winners or third parties.
We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in the Promotion, technical errors, or any other reason that is not under the control of LOFFMUSIC ENTERTAINMENT, SL and that affects the normal development of the Promotion, we reserve the right to cancel, modify, or suspend the Promotion, including the participation web page or Instagram post.
- PROTECTION OF PERSONAL DATA

In accordance with the provisions of the applicable regulations on data protection, and specifically in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each participant, with the acceptance of these Legal Bases consents that the personal data provided for participation in this contest will be incorporated into a file owned by LOFFMUSIC ENTERTAINMENT, SL, for the purpose of managing the Promotion, as well as disseminating and publicizing its results, and processing the delivery of the prize.
Participants guarantee that the personal data provided are truthful and are responsible for communicating to LOFFMUSIC ENTERTAINMENT, SL any changes to them. LOFFMUSIC ENTERTAINMENT, SL reserves the right to exclude from this promotion any participant who has provided false information. It is recommended to have the maximum diligence in Data Protection through the use of security tools, and LOFFMUSIC ENTERTAINMENT, SL cannot be held responsible for theft, modification or loss of illicit data.
Participants are entitled to (i) to access your personal data, as well as to (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of your data, (iv) object to the processing of his or her data and (v) request portability. Participants may exercise all these rights by sending an e-mail to legal@loffmusic.com indicating the reason for their request.
Without prejudice to any other administrative remedy or judicial action, the participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not in compliance with the regulations, as well as in case he/she is not satisfied with the exercise of his/her rights.
The Control Authority to which the complaint has been submitted shall inform the complainant of the progress and outcome of the complaint.
Therefore, the participant declares to have been informed of the conditions on personal data protection, accepting and consenting to the treatment.
- CHANGES AND ACCEPTANCE
LOFFMUSIC ENTERTAINMENT, SL reserves the right to modify or extend these promotional terms and conditions, to the extent that it does not prejudice or undermine the rights of the participants in the Promotion.
The mere fact of participating in the sweepstakes implies that the participant fully accepts the conditions of these Terms and Conditions. Likewise, participation in a sweepstakes of this nature implies acceptance of the rules of the social network Instagram through which the sweepstakes takes place.
APPLICABLE LAW AND JURISDICTION
These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the city of Madrid will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
